3. Client Business Responsibility

CODE4UTECH provides technology and related professional services.

Unless expressly agreed otherwise in writing, we do not operate, manage, control, own, or supervise the client's underlying business.

The client remains responsible for:

Its business activities
Products and services
Customers and users
Pricing
Transactions
Advertising claims
Marketing decisions
Content
Uploaded information
Customer communications
Regulatory registrations
Licences and permits
Tax obligations
Industry-specific compliance
Consumer obligations
Data collected through the client's systems
Consent obtained from the client's users
Intellectual property supplied by the client

The fact that technology is developed, hosted, integrated, maintained, or supported by CODE4UTECH does not transfer responsibility for the client's business activities to CODE4UTECH.

4. Legal and Regulatory Compliance

CODE4UTECH seeks to comply with laws applicable to its own business and services.

Depending on the nature, location, and purpose of a particular service, applicable legal requirements may include Indian laws and, where relevant, foreign or international requirements.

These may include requirements relating to:

Data protection and privacy
Consumer protection
Intellectual property
Contract law
Taxation

Where a client operates in another country, the client remains responsible for determining which laws apply to its business and for configuring and using the technology accordingly, unless CODE4UTECH has expressly agreed in writing to provide a specific compliance service.

Other jurisdictions where our services are legally permitted

International clients may be subject to local privacy, consumer, tax, advertising, accessibility, cybersecurity, electronic communication, and industry-specific requirements.

Unless expressly agreed otherwise, CODE4UTECH does not act as the client's legal or regulatory advisor.

6. Client-Provided Content and Materials

Clients may provide:

The client represents that it has the necessary rights, permissions, licences, and authority to provide such materials to CODE4UTECH for the agreed purpose.

CODE4UTECH does not assume ownership of client-provided intellectual property merely because such material is uploaded, shared, integrated, or used during a project.

7. Third-Party Services

Our solutions may integrate with third-party platforms and services, including:

Google services
Advertising platforms
Payment gateways
Cloud providers
Hosting providers
Email providers
SMS providers
WhatsApp or communication platforms
Maps and location services
Analytics providers
Social media platforms
APIs
Plugins
Open-source software

Third-party services are governed by their own terms, privacy policies, technical limitations, pricing, and availability.

CODE4UTECH cannot guarantee uninterrupted operation of services controlled by independent third parties.

8. Intellectual Property

Unless otherwise agreed in writing:

  • CODE4UTECH retains rights in its pre-existing technology, frameworks, libraries, reusable components, tools, methodologies, templates, know-how, infrastructure, and internal systems.
  • Client-specific deliverables and ownership rights are governed by the applicable project agreement, proposal, quotation, or Statement of Work.
  • Open-source and third-party components remain subject to their applicable licences.
  • CODE4UTECH does not transfer ownership of third-party intellectual property that it does not own.

9. Security

CODE4UTECH uses reasonable technical and organizational measures appropriate to the nature of the services and information handled.

Depending on the project, security measures may include:

Authentication

Secure development practices

Backup procedures
Monitoring
Logging
Security updates
Role-based access
Infrastructure controls

No internet-connected system can be guaranteed to be completely secure.

Clients are also responsible for maintaining appropriate security over their accounts, credentials, devices, administrators, users, and third-party services.

10. Account Responsibility

Where a service provides user accounts, clients and users are responsible for:

Keeping login credentials confidential
Providing accurate information
Maintaining authorized access
Not sharing credentials improperly
Reporting suspected unauthorized access
Using the service lawfully

CODE4UTECH may suspend or terminate accounts that are reasonably believed to involve fraud, abuse, illegal activity, security threats, or material violations of applicable terms.

11. Prohibited Activities

Hacking
Unauthorized access

Financial scams
Money laundering
